Video Summary
Alison Green (Consultant, MI Member firm Mackrell LLP, London) chaired the meeting at which Geeta Patel (Senior Associate Mackrell LLP, London) presented to the group on jurisdictional issues in international divorce cases, with focus on how English courts determine jurisdiction and handle temporary measures like Hemain injunctions. This subject sits at the very heart of modern family law practice. In an increasingly globalised world, where families live, work, and build their lives across multiple countries, questions of jurisdiction—which court has the authority to hear a divorce or resolve related disputes—have become some of the most intricate and consequential issues confronting practitioners today.
Participants shared experiences from different jurisdictions, including Scotland, Canada and the Philippines, discussing residency requirements and challenges in cross-border family law cases. The discussion concluded with updates to LinkedIn groups and plans to share meeting materials through Mackrell International Family Law's LinkedIn group.
