Join PG Chair Alison Green for the next Family Law Practice Group Call where we will be discussing navigating international disputes and related issues affecting family law practice today.

On the call, we’re pleased to have Michael Zimmerman of MI Firm LK Law (Vancouver) (https://lklaw.ca/our-people/michael-zimmerman/ ) join us and present on a fast-moving multiple jurisdiction international custody dispute in which he was involved.

Such cross-border parenting disputes often involve complex arguments over custody and visitation rights across borders, as legal processes vary by country. One significant treaty aiding these cases is The Hague Convention on the Civil Aspects of International Child Abduction. This treaty establishes a legal framework for the swift return of children who are unlawfully removed or retained in a different country.

Successfully handling international custody cases requires knowledge of varying legal systems and a deep understanding of international law.

Michael’s session will provide a primer on the following topics:

  • The Hague Convention on the Civil Aspects of International Child Abduction is the primary treaty governing international child custody disputes, aiming to prevent child abductions and secure the return of abducted children.

  • The best interests of the child are the cornerstone of custody decisions, whether in domestic or international courts.

  • Jurisdictional disputes over where a custody case should be heard are often central to international custody conflicts.

  • Enforcing custody orders across borders can be highly challenging, particularly with non-signatory countries.
