Sharing AI generated non-consensual intimate images (NCII) and AI deepfake porn is a federal crime, a consumer protection problem for platforms (Florida) and a private tort (California).
Join us on 2nd December at 2.30 pm UK GMT for Mackrell AI Practice Group session, in the wake of the federal TAKE IT DOWN Act, we’ll hear both:
Florida – 20 minutes: Sarah Studzinski (Zimmerman, Kiser & Sutcliffe) will focus on Florida HB 1161 (“Brooke’s Law”) as the Florida model for AI-altered sexual depictions: scope of covered services, victim takedown process, timelines, verification, re-upload issues, and remedies.
California – 20 minutes: Nikki A. Docherty (Hoge Fenton Jones & Appel) will discuss AB 621’s revisions to California Civil Code section 1708.86 as the California deepfake-pornography remedy, who can be sued (creators, distributors, facilitators), elements, defenses, and damages.
Followed by an open 20-minute Q&A and discussion.
