Formal requirements

Mexico does not currently offer a golden visa; however, it does offer a Temporary Resident Visa for investors (the “Visa”). This Visa allows foreign nationals to obtain a resident condition in Mexico for more than 180 days and up to four years (with the possibility of renewal for an addition period) by making qualifying investments in Mexico.

This process is divided in two main steps.

1. The application for this Visa must be submitted directly by the applicant at any of the Mexican Consulates abroad, either in the foreign national’s country of origin or, if applicable, in the country where the foreign national currently resides. The main requirements are as follows:

 Documents proving investment under any of the following conditions: 

  1. The applicant must be a current shareholder of a Mexican company. Document from the Mexican legal entity, certified by Mexican Notary Public or competent authority, confirming the foreign national’s participation in the corporate capital of a Mexican company. A specific amount is required depending on the Mexican Consulate where the process is initiated; and

  •  Document proving ownership of movable or fixed assets of a foreign legal entity used for economic activities. A specific amount is required depending on the Mexican Consulate where the process is initiated; or

  • Documents demonstrating the development of economic activities in Mexico, such as contracts, service orders, invoices, business plans, licenses, or a certificate from the Mexican Social Security Institute (IMSS) confirming employment of at least three employees.

The applicant must perform an interview before the Mexican Consulate, where it will be questioned by a consular agent regarding to its investments in Mexico. Appointments may be scheduled through the Ministry of Foreign Affairs’ electronic system or directly via the Consulate’s contact e-mail (depending on the internal Consulate’s policies).

After obtaining the Visa, the foreign national may enter Mexico once and must complete the process to exchange the Visa for a Temporary Residence Card (“TRC”) at the Mexican Immigration Institute (“INM”) within 30 days as of its entrance. Failure to carry out this process invalidates the Visa, requiring restarting. The INM typically concludes the process of issuance of the TRC within 20 business days, once started.

The TRC will initially be valid for a term of one year and can be renewed for an additional period of 4 years within the 30 days before its expiration. After completing four years of residence in Mexico, the foreign national may apply to change the temporal resident condition to a permanent resident.
